It’s interesting how the younger and less constrained Obama is able to flatly state the fact that the War on Drugs has been an utter failure and that marijuana should be decriminalized while still maintaining his opposition to legalization.
I’m all for gradual steps and half-measures that push our society in a positive direction – rather than abrupt shifts that prompt backlashes. And I think Obama has the politics of this right, if not the policy – decriminalization must come first and separate from legalization. But once pot is decriminalized, the logic of it’s legalization becomes inevitable. The problem is that decriminalization could just as easily aid the Mexican drug cartels in the short term – as they take advantage of the gray area in which marijuana would exist legally. Of all 7 positive effects that would be possible if marijuana were legalized, only 3 of them would be partially accomplished by decriminalization.
The prudent political path then is to make the case for legalization while pushing for decriminalization – with the knowledge that the latter will lead to the former.

On this April 20th, the case to legalize marijuana is a no-brainer. There are at least 7 things that could be accomplished by legalizing it:
- Stabilize Mexico. The drug cartels are waging a war against the Mexican government and each other funded mainly by the profits from marijuana sales in the United States. Legalizing marijuana would create an opportunity for the current government’s attacks on the cartels to succeed – as the cartels would need to scramble to find alternate sources of revenue while fighting a war against a military bolstered by American aid.
- Stop wasting money on a failure. Barack Obama called the war on drugs “an utter failure.” Since he took office, he has vowed to cut the fat from the federal budget and eliminate failed programs. At a time when our tax dollars are at a premium, why should we continue to waste money on a failed government program?
- Protect the legitimacy of our laws. Almost half of all Americans admit to have tried marijuana – including 3 of our past 3 presidents – which means that they all broke the law. Such flagrant law-breaking undermines respect for the Rule of Law – and more important, once Americans break the law they can see how distorted the government propaganda campaign against marijuana is – further undermining respect for the government. America is currently waging a war on its citizens the likes of which have rarely been seen in history – as we imprison a greater percentage of our population than any other nation on earth and continue to militarize our police as they stop enforcing community standards and instead impose federal policies using extreme force.
- Stop aiding terrorists. According to a 2004 Congressional report, the illegality of drugs has incentivized a vast system of money laundering, smuggling, and corrupting of government officials – as well as created failed states and lawless regions – all of which aid terrorists seeking to carry out attacks on the United States. The criminalization of marijuana creates the biggest incentive on all of these fronts.
- Reduce crime. The War on Drugs has been militarizing America’s police forces and eating up resources which has led to a statistical uptick in non-drug related theft and violent crime synchronous with this shift. As police resources are spent enforcing federal drug laws – arresting, testifying, surveiling – and as the police become more militarized and distant from the communities they are charged with policing – serious non-drug related crimes increase. One report quantified this by explaining that every additional drug arrest leads to an increase of 0.7 Index (serious) crimes [page 6 of the pdf].
- Stimulate the economy. Obama may have tittered at the question, but there is precedent – the repeal of the prohibition of alcohol when FDR took office during the Great Depression.

List Week! coming 4/20
This blog is on vacation until April 20, 2009 – which will be “List Week!” including lists of the Ten Core Principles of Market-State Liberalism (inspired by Russell Kirk’s Principles of Conservatism), a list of competing theories of the financial crisis, a list of reasons why marijuana should be legalized, and more!
In lieu of a substantial column on my part – I’m in one of those places where I’m stuck in the middle of three or possibly four longer pieces – here’s a quick collection of related thoughts:
David Brooks in the New York Times:
To me, the most interesting factor is the way instant communications lead to unconscious conformity. You’d think that with thousands of ideas flowing at light speed around the world, you’d get a diversity of viewpoints and expectations that would balance one another out. Instead, global communications seem to have led people in the financial subculture to adopt homogenous viewpoints. They made the same one-way bets at the same time.
Brooks is talking about instant communications in finance, but he’s onto something that has been evident to close observers of the internet social networking since it’s inception. The instantaneousness of the communication – the sharing – leads to conformity. It seems that instant reactions to events are more uniform that our individual reflective understandings. At the same time, the speed of the communication creates a kind of self-reinforcing wave as each individual reaction begins to affect the event itself – especially as related to markets or other systems that are open to individual input. Online instant communication then creates a kind of “conformity by sharing.” One excellent example of this is the flash mob. Flash mobs have an additional conforming pressure – the desire to be part of the in-crowd. They also seem to have a particular agenda – to shock the public with organized spontaneity. (Here’s two of my favorite flash mob events – in Grand Central, New York and Antwerp, Belgium.)
This conformity by sharing via the internet has already had more significant effects than the flash mobs. For example, the Obama campaign derived a large amount of energy from online organizing and networking – though this online component was balanced with a more traditional campaign. The Orange Revolution in Ukraine was said to be organized in large part by text messaging via a primitive social network. It’s interesting to see how this is playing out in the Twitter revolution in Moldova.
Somewhat related to the Twitter revolution, Joshua Keating makes a wise observation regarding protests in a short piece entitled “Do protests ever work?” in Foreign Policy:
Rather than organizing around a specific political goal, ending the war, these marches tend to devolve into general lefty free-for-alls encompassing everything from Palestine to free trade the environment to capital punishment.
I would add that, at least in democratic societies, protests that demand accountability or consistency from “the system” tend to be more effective than one that seek to overturn it.
Keating was referring to the G-20 protests in London.
Fortunately they acted like normal people.
Günter Schabowski explaining why the border patrols in East Germany did not open fire on the crowds illegally crossing the border despite their instructions to do so.
The contrast between Hannah Arendt’s description of Adolf Eichmann and the other Nazis whose orderly actions reflected the “banality of evil” and Schabowski’s labeling of the decision by soldiers not to open fire as similarly banal is striking.
I’m not sure what to make of it – and I’m curious as to what Schabowski would.
Vanessa Grigoriadis in New York captures many of my mixed feelings about Facebook. One of the most fascinating yet disturbing aspects of Facebook is the giant web of relationships that is being constructed through it – a web of relationships which is not strictly our own, yet seems particularly personal. Facebook of course wishes to mine this data for profit (or perhaps for the CIA). But more interesting and disturbing is the social graph (almost all-knowing) that is being created of humanity in general – with you placed right in the middle:
This is part of who I am now—somebody who knows that her nursery-school tormentor wasn’t a bully without a heart. It will get logged into my profile, and that profile will become part of the “social graph,” which is a map of every known human relationship in the universe. Filling it in is Facebook’s big vision, a typically modest one for Silicon Valley. It’s too complex for a computer scientist to build. Just as our free calls to GOOG-411 helped Google build its voice-recognition technology, we are creating the graph for Facebook, and I’m not sure that we can take ourselves out once we’ve put ourselves on there. We have changed the nature of the graph by our very presence, which facilitates connections between our disparate groups of friends, who now know each other. “If you leave Facebook, you can remove data objects, like photographs, but it’s a complete impossibility that you can control all of your data,” says Fred Stutzman, a teaching fellow studying social networks at the University of North Carolina at Chapel Hill. “Facebook can’t promise it, and no one can promise it. You can’t remove yourself from the site because the site has, essentially, been shaped by you.”
Grigoriadis captures nicely the paranoia that seems evident in this wariness of Facebook’s possible ulterior motives:
Kubrick dreamed of villains like this: nerds in fleece, controlling the information, calling their cult a family. It was an image, a kind of inchoate anxiety about the future, rather than anything you could put your finger on.
Inchoate anxiety – there’s been a lot of that going around recently.
On the one hand, I love Facebook for the connections to people from my past – and for the ease with which I can connect to people for my future. I love the control it gives me – and the way it reminds me when it’s someone’s birthday or lets me know that a friend I have lost contact with married his college sweetheart. But next to this love is a vague, unsettled feeling – an unease. What are they planning on doing with this extremely valuable information?
[digg-reddit-me]Charles Krauthammer in a typically insightful yet wrong-headed article carries out an intriguing thought experiment:
Five minutes of explanation to James Madison, and he’ll have a pretty good idea what a motorcar is (basically a steamboat on wheels; the internal combustion engine might take a few minutes more). Then try to explain to Madison how the Constitution he fathered allows the president to unilaterally guarantee the repair or replacement of every component of millions of such contraptions sold in the several states, and you will leave him slack-jawed.
I’m somewhat surprised that Krauthammer knows who James Madison is – given his reluctance to acknowledge the Constitution places any limits on executive power in the realm of national security in direct contravention of Madison’s understanding of his Constitution. But I suppose Krauthammer rationalizes that away by explaining that the Constitution is not a “suicide pact” and thus in times of physical danger can be safely stored away – but in an economic emergency, it must constrict the president as much as possible to preserve the status quo. But by exclaiming how shocked Madison would be at power politics, Krauthammer manages to make Madison out to be a naif – rather than the student of human nature and power that he was.
Still, one can rightly imagine Madison questioning how we got here. So, I will answer Madison’s hypothetical question, namely – “How is it that the limited government he constructed in his Constitution can allow the president to unilaterally guarantee the repair or replacement of every component of millions of such contraptions sold in the several states?”
Because, Mr. Madison, in 1929, with a small percentage of Americans gaining control of a large chunk of the nation’s economy, the market broke down and the government was forced to assume some partial responsibility for the well-being of it’s its citizens and to curb the excesses of the markets.
Then, in 1980, the government began reducing it’s its responsibility for the well-being of its citizens and removing the safeguards put in place to prevent another disasterous market breakdown. This led to another thoroughly undemocratic concentation of power – which the public accepted in return for the assurance that their standard of living would constantly improve. And so it was under Ronald Reagan that the government became responsible for assuring constant economic growth that would benefit all classes of society, at least a bit.
And now, that arrangement has come to a screeching halt.
Obama is proposing a new social bargain – a fact which Krauthammer recognizes. But Krauthammer sees this bargain in terms that were relevant in the 1980s – as a resurgence of the Great Society liberalism he grew to hate. But instead, Obama proposes a new market-state liberalism – in which the government accepts a responsibility to referee and more actively maintain the markets and to provide investments that are too capital-intensive and long term for corporations with their limited time horizons to finance. Obama also believes it is the government’s role to reduce the disruption and instability that the creative destruction of capitalism wreaks. The end goal is to create a more level playing field and mainly through soft government pressure prevent destabilizing concentrations of power.
Krauthammer though only sees Lyndon Johnson reborn intent on “leveling” society and reducing the inequities between the rich and the rest of us. Krauthammer explains that for Obama the “ultimate social value is fairness” – and Krauthammer means this as a bad thing. The subtlety that Krauthammer sidesteps is that Obama is in favor of fair processes rather than enforcing some pre-determined fair ends. This was the traditional position of the conservative – but it is position that conservatives have long since abdicated. Presumably when he criticizes fairness, Krauthammer believes that markets should strive for efficiency rather than fairness – but he neglects to make any case that our current market structure is efficient.
Michael Osinski described in New York magazine the logic of how money is awarded on Wall Street:
I was very good at programming a computer. And that computer, with my software, touched billions of dollars of the firm’s money. Every week. That justified it. When you’re close to the money, you get the first cut. Oyster farmers eat lots of oysters, don’t they?
This describes neither a fair nor an efficient way of distributing resources. What “conservatives” such as Krauthammer do not realize is that capitalism, like democracy, is merely the least-worst system of managing the market – and that just as democracy’s excesses must be managed, so must capitalism’s. Krauthammer does not seem to accept that the structure of governance is changing with globalization – as the nations of the world are evolving into market-states. It was the beginning of this shift that led to Ronald Reagan’s and Margaret Thatcher’s success. Although some conservatives saw these successes as a return to a pre-Great Society or a pre-New Deal America, they represented instead a shift forward, an evolution from nation to market-state. Liberals lost elections because their solutions no longer spoke to this evolved America – and they could not see the sand shifting beneath themselves. They were stuck in the past.
But now – as Niall Ferguson has admitted – it is only the liberals who are providing a coherent answer to the challenges we face.
Krauthammer – like far too many conservatives today – is stuck pretending we face the challenges of the 1980s all over again. Until conservatives like him notice the sand shifting beneath them, they will have little to offer. As a well-functioning democracy requires at least two functioning political parties, I hope they get their heads our of the sand sooner rather than later.
[digg-reddit-me]A thought-provoking essay by Liam Julian in the Hoover Institution’s Policy Review explores the relationship between Obama and Reinhold Niebuhr. The essay unsurprisingly concludes that Obama failed to learn the essential lesson of Niebuhr (unsurprising because it appears in the far-right Policy Review) – namely that:
[M]an must act forcefully but humbly and free from naïve expectations.
Julian explains the appeal of this Niebuhrianism as a kind of balancing act:
[Obama] is a liberal, as was Niebuhr, and idealism smolders within even the most sensible liberals. The point is not to suffocate the idealism but to control its flames…
The conservative Julian sees Obama flaming idealistically in his first few months in office because any liberalism is too much for him. But E. J. Dionne – like most liberals – sees Obama as constantly balancing opposites, attempting to control the risks associated with progress while not yielding to a reactionary politics:
That’s the Obama enigma: boldness wrapped in caution rooted in an ambivalent relationship to the status quo. This is why Obama will, by turns, challenge not only his entrenched adversaries but also his natural allies.
The Obama enigma is about balancing opposites. It is an idealistic pragmatism, a conservative liberalism. This constant balancing is inherent in every aspect of the Obama administration. As James Surowiecki observes in the New Yorker with regards to the banking crisis for example:
[T]he Administration is trying to do two things at once. In solving the current crisis, it’s partnering with Wall Street, using the existing system to try to stabilize the economy. But in thinking about the future it’s trying to use hostility to Wall Street to bring about serious changes in the system. This is quite a balancing act: let’s hope the Administration can pull it off.
