The Significance of Jack Bauer

The most influential legal thinker in the development of modern American interrogation policy is not a behavioral psychologist, international lawyer or counterinsurgency expert…the prime mover of American interrogation doctrine is none other than the star of Fox television’s “24,” Jack Bauer.

Though Lithwick’s statement may sound like an exaggeration, the most common defense of America’s torture policy has been to invoke the character of Jack Bauer on 24. John Yoo, Diane Beaver, Michael Chertoff, Tom Tancredo, and most famously Antonin Scalia have all invoked the TV show 24 in describing and defending national security law under George W. Bush. U.S. Army Brigadier General Patrick Finnegan, the dean of the United States Military Academy at West Point, saw the show’s influence as so pernicious that he he flew to visit the show’s producers to ask them to stop representing torture in such a positive light as it was undermining national security:

[Brigadier General] Finnegan told the producers that “24,” by suggesting that the U.S. government perpetrates myriad forms of torture, hurts the country’s image internationally. Finnegan, who is a lawyer, has for a number of years taught a course on the laws of war to West Point seniors—cadets who would soon be commanders in the battlefields of Iraq and Afghanistan. He always tries, he said, to get his students to sort out not just what is legal but what is right. However, it had become increasingly hard to convince some cadets that America had to respect the rule of law and human rights, even when terrorists did not. One reason for the growing resistance, he suggested, was misperceptions spread by “24,” which was exceptionally popular with his students. As he told me, “The kids see it, and say, ‘If torture is wrong, what about “24”?’ ” He continued, “The disturbing thing is that although torture may cause Jack Bauer some angst, it is always the patriotic thing to do.”

It sounds as if the gullible students in Finnegan’s class have taken their lead from Justice Scalia who, in defending the extraordinary measures of the Bush administration, asked: 

Jack Bauer saved Los Angeles…He saved hundreds of thousands of lives…Are you going to convict Jack Bauer?

Lieutenant Colonel Diane Beaver, whose legal memoranda aided the justification torture, claimed that Jack Bauer “gave people lots of ideas” about how to interrogate prisoners.

One thing that most of these defenders of torture do not mention – and that many opponents of torture fail to bring up – is that torture doesn’t seem to work. This is in many respects a secondary question – as the morality of torture and the “by any means necessary” approach of Jack Bauer as well as the Bush administration is debated. But Matthew Alexander, a pseodonym for a military interrogator who led the team that found Abu al-Zarqawi in Iraq, has been a vocal defender of the view that torture is an inefficient and counterproductive interrogation tool. The FBI has long maintained that their methods are proven and get reliable information from subjects – as opposed to the new torture techniques that do not. Neither the Nazis nor the Communists interrogated their high-value detainees – not because of their respect for human rights, but because they saw what was most effective. The greatest Nazi interrogator was a Hanns-Joachim Schraff who never even raised his voice, let alone tortured his subjects. He was one of the few top Nazis not tried for war crimes. Matthew Alexander – the man who got the intelligence that led to Zarqawi’s death – was one of the few adherents to Schraff’s view of interrogation in Iraq. His interrogation tools, rather than fear, violence, torture, religious persecution, and intimidation were “respect, rapport, hope, cunning, and deception.” 

Ann Applebaum points to the obvious question:

Given the overwhelmingly negative evidence, the really interesting question is not whether torture works but why so many people in our society want to believe that it works.

It may be unfair to blame 24 for this belief in the efficacy of torture. There is something deeper at work here than the propaganda of a television show. But 24 puts forth a persuasive cultural argument in which the extreme circumstances that occur every hour on the show justify extreme actions (such as threatening to harm an infant, mock executions of children; regular torture) are then used to justify American policies.

Clear-eyed Engagement

Roger Cohen continues to make the case for clear-eyed engagement with Iran

Let’s be clear: Iran’s Islamic Republic is no Third Reich redux. Nor is it a totalitarian state.

He suggests that Iran may prove to be what George W. Bush and the neoconservatives tried to make Iraq into:  a model for the Middle East of what a country that has come out the other side of extremism looks like, quoting a friend:

“Iran — the supposed enemy — is the one society that has gone through its extremist fervor and is coming out the other end. It is relatively stable and socially dynamic.”

Fareed Zakaria in a Newsweek article seemingly designed to provoke the ire of the right-wing argues that:

We can better pursue our values if we recognize the local and cultural context, and appreciate that people want to find their own balance between freedom and order, liberty and license. In the end, time is on our side. Bin Ladenism has already lost ground in almost every Muslim country. Radical Islam will follow the same path. Wherever it is tried—in Afghanistan, in Iraq, in parts of Nigeria and Pakistan—people weary of its charms very quickly. The truth is that all Islamists, violent or not, lack answers to the problems of the modern world. They do not have a world view that can satisfy the aspirations of modern men and women. We do. That’s the most powerful weapon of all.

Afpak & Iran

I’ve highlighted a bunch of different articles in the past week about the upcoming challenges in Afghanistan and Pakistan with Iran as a potential complicating factor. Here’s my attempt to cram all of these highlights into one post…

Jodi Kantor in the New York Times on Richard Holbrooke and Afpak:

For now, Holbrooke is both raising expectations and lowering them. He is talking about Afpak – Washington shorthand for his assignment – as his last and toughest mission. But along with the rest of Obama’s foreign-policy staff, he is also trying to redefine success in the region, shifting away from former President George W. Bush’s grand, transformative goals and toward something more achievable. 

Fareed Zakaria has some ideas on what at least one of these less exalted goals should be:

In May 2006 a unit of American soldiers in Afghanistan’s Uruzgan valley were engulfed in a ferocious fire fight with the Taliban. Only after six hours, and supporting airstrikes, could they extricate themselves from the valley. But what was most revealing about the battle was the fact that many local farmers spontaneously joined in, rushing home to get their weapons. Asked later why they’d done so, the villagers claimed they didn’t support the Taliban’s ideological agenda, nor were they particularly hostile toward the Americans. But this battle was the most momentous thing that had happened in their valley for years. If as virile young men they had stood by and just watched, they would have been dishonored in their communities. And, of course, if they were going to fight, they could not fight alongside the foreigners.

In describing this battle, the Australian counterinsurgency expert David Kilcullen coins a term, “accidental guerilla,” to describe the villagers. They had no grand transnational agenda, no dreams of global jihad. If anything, those young men were defending their local ways and customs from encroachment from outside. But a global terrorist group—with local ties—can find ways to turn these villagers into allies of a kind. And foreign forces, if they are not very careful, can easily turn them into enemies.

Reduced to its simplest level, the goal of American policy in Afghanistan should be to stop creating accidental guerrillas. It should make those villagers see U.S. forces as acting in their interests. That would mark a fundamental turnaround.

Another major problems is – as Tom Ricks quotes Abu Muquwama to explain – that:

It’s tough to fight a war in Afghanistan when the opposing team decides to fight the war in Pakistan

At the same time, Pakistan seems to be dragging it’s feet with regards to destroying the forces it considered – until recently – it’s proxies in it’s struggle with India for regional power, the Taliban. This creates a nagging feeling of suspicion among Pakistan’s allies, as Eric Schmitt and Mark Mazzetti explained in the New York Times:

In recent years, there have been some significant successes in the hunt for Taliban leaders. Pakistani operatives tracked Mullah Dadullah, a senior aide to Mullah Omar, as he crossed the Afghan border in May 2007, and he was later killed by American and Afghan troops.

Yet most of the arrests in Pakistan have coincided with visits by senior American officials.

The arrest of Mullah Obeidullah, the former Taliban defense minister, in Quetta in February 2007 coincided with the visit of Vice President Dick Cheney to Afghanistan and Pakistan. It is unclear whether Mullah Obeidullah is still in Pakistani custody or was secretly released as part of a prisoner exchange to free Pakistan’s ambassador to Afghanistan, who was kidnapped last February and released three months later.

Schmitt and Mazzetti clearly convey the suspicion among top American officials that Pakistan’s wars against its terrorists are mainly a public relations effort to pacify America. Pakistan’s reluctance to fully accept America as an ally (believing we will again retreat from the region after we are done with Afghanistan one way or another, as we did after the Soviet Union was defeated there) is not our only challenge in the region. Parag Khanna of Foreign Policy describes how Afpak is also the center of maneuvering by other nations:

China, Saudi Arabia, and Iran are also becoming increasingly important – not as neighbors of the chaos, like Pakistan, but meddlers in it. The United States is already failing to grasp not only the details of other powers’ maneuverings in Afghanistan and Pakistan, but the extent to which these dealings could eclipse even the most brilliant U.S. shuttle diplomacy by Holbrooke.

He describes how China has become Afghanistan’s largest investor, how Saudi Arabia continues to funnel enormous amounts of money to fund religious extremism in the region, including Wahabbi mosques, and how Iran is taking steps to provide energy for what they anticipate will be shortages in Afpak and India. Khanna – seeing this pipelines and other relations between Iran, India, Afghanistan, and Pakistan as inevitable as all partners stand to benefit – suggests America get out in front and support the pipeline. Better to build it ourselves than having it built without us.

Building roads and controlling their usage has for centuries been the foundation of spreading Silk Road influence, as well as the key to success in the 19th-century Great Game. Today’s struggle for control follows similar rules.

This Great Game – a term historically used to describe the strategic competition for influence in the region, especially when it involves great intrigues and turnabouts –  would seem to require us to neutralize or flip Iran into an ally. Roger Cohen of the New York Times makes the case:

Iran’s political constellation includes those who have given past support to terrorist organizations. But axis-of-evil myopia has led U.S. policy makers to underestimate the social, psychological and political forces for pragmatism, compromise and stability. Iran has not waged a war of aggression for a very long time.

Tehran shares many American interests, including a democratic Iraq, because that will be a Shiite-governed Iraq, and a unified Iraq stable enough to ensure access to holy cities like Najaf.

It opposes Taliban redux in Afghanistan and Al Qaeda’s Sunni fanaticism. Its democracy is flawed but by Middle East standards vibrant. Both words in its self-description — Islamic Republic — count.

A Double Standard

Tamm’s story is in part a cautionary tale about the perils that can face all whistleblowers, especially those involved in national-security programs. Some Americans will view him as a hero who (like Daniel Ellsberg and perhaps Mark Felt, the FBI official since identified as Deep Throat) risked his career and livelihood to expose wrongdoing at the highest levels of government. Others—including some of his former colleagues—will deride Tamm as a renegade who took the law into his own hands and violated solemn obligations to protect the nation’s secrets. “You can’t have runoffs deciding they’re going to be the white knight and running to the press,” says Frances Fragos Townsend, who once headed the unit where Tamm worked and later served as President Bush’s chief counterterrorism adviser. Townsend made clear that she had no knowledge of Tamm’s particular case, but added: “There are legal processes in place [for whistle-blowers’ complaints]. This is one where I’m a hawk. It offends me, and I find it incredibly dangerous.”

As Hilzoy points out, Townsend was one of the people responsible for making sure that the whistle-blower process worked for Tamm:

Saying that whistleblowers ought to work within the system without adding “if the system is in fact functional” is odd in itself. But saying that when you are one of the people who could have helped to make it functional amounts to saying: well, I and my colleagues have failed to do our jobs, but never mind that: we should expect whistle-blowers to work within the system, even if our own failure means that they have no reason to believe that doing so will actually accomplish anything other than the destruction of their careers.

In a CNN appearance attacking Scott McClellan when he released his book, Townsend seemed to make the exact opposite point of Hilzoy – suggesting that career destruction is the price you must pay:

You know, if there’s policy issue that you think violates your personal values or your integrity and ethics, you do have an option. You can voice it and if you lose, you leave.

Which is probably why Townsend was relieved to have been deliberately marginalized on sensitive national security issues by Vice President Cheney and his staff while she served as a counter-terrorism adviser. (Her very appointment was also opposed by Scooter Libby and was apparently somehow tied in to the Valerie Plame leaking.)

The great irony is the clear double standard applied by people like Frances Fragos Townsend to condemn only those who politically opposed them for acting as renegades who take the law into their own hands thereby violating solemn obligations to protect the nation and its values while giving other a free pass. Yes – Thomas Tamm, a lone individual with few powers, unable to affect what he believed to be flagrant law-breaking (and what later events have proved to be at minimum felony crimes), took it upon himself to protect the Rule of Law, thus breaking one law to uphold the many. And yes – George W. Bush, the most powerful man in the world, unwilling to concede that his powers had limits when he feared bad things would happen, broke many laws and ordered many more laws to be broken, to such a degree that he challenged the very concept of limits on the executive itself, corrupting the entire system that was designed to check his powers. Both men broke the law to protect America.

One man corrupted the system designed to check him; the other took on that corrupted system. Yet Townsend – and many like her – argue that the petty criminal who broke the law (for the common good) should be prosecuted while the master criminals who broke many laws (for the common good) should not be. This demonstrably creates two classes under the law – those above it and those subject to it.

John Adams described the definition of a republic as “a government of laws and not of men.” Thomas Paine declared in Common Sense that “in absolute governments the king is law, [while] in free countries the law ought to be king; and there ought to be no other.” It is this fundamental American principle which Frances Fragos Townsend and other Bush administration apologists attack when they insist that only the dissenters and the powerless be punished for breaking the law.

The Surge that Took Down the Red Cross

[digg-reddit-me]Evan Thomas of Newsweek has written up an excellent series of seven articles from the research of a team of reporters given behind-the-scenes access to the McCain and Obama campaigns on the condition that they not publish anything until after the election. At the end of the fourth article, he explains an incident that demonstrates the sheer organizing power of the Obama operation:

At the end of August, as Hurricane Gustav threatened the coast of Texas, the Obama campaign called the Red Cross to say it would be routing donations to it via the Red Cross home page. Get your servers readyour guys can be pretty nuts, Team Obama said. Sure, sure, whatever, the Red Cross responded. Weve been through 9/11, Katrina, we can handle it.

The surge of Obama dollars crashed the Red Cross Web site in less than 15 minutes.

The curmudgeonly conservative columnist questions McCain

George Will, curmudgeonly conservative columnist, pointedly asks John McCain a few worthwhile questions in yesterday’s column:

  1. You say you are not “ready to go to war with Iran,” but you also say the “one thing worse” than “exercising the military option” is “a nuclear-armed Iran.” Because strenuous diplomacy has not dented Iran’s nuclear ambitions, is not a vote for you a vote for war with Iran?
  2. You vow to nominate judges who “take as their sole responsibility the enforcement of laws made by the people’s elected representatives.” Their sole responsibility? Do you oppose judicial review that invalidates laws that pure-hearted representatives of the saintly people have enacted that happen to violate the Constitution? Does your dogmatic deference to popular sovereignty put you at odds with the first Republican president, who nobly insisted that there are some things the majority should not be permitted to do—hence his opposition to allowing popular sovereignty to determine the status of slavery in the territories? Do you also reject Justice Antonin Scalia’s belief that the Constitution’s purpose is “to embed certain rights in such a manner that future generations cannot readily take them away”? Does this explain your enthusiasm for McCain-Feingold’s restrictions on political speech, and your dismissive reference to, “quote, First Amendment rights”? Would you nominate judges who, because they think those are more than “quote … rights,” doubt McCain-Feingold’s constitutionality?
  3. Having raised $95 million in February and March, Barack Obama is reconsidering whether to rely on taxpayer funding in the general election, which would limit him to spending only $84.1 million. You denounce Obama for this, but your adviser Charles Black says, “We could sit down in July or August and say, ‘Hey, we’re raising a lot of money and maybe we should forgo [taxpayer financing].’ We don’t have enough data.” Really, how does your position differ from Obama’s?
